When buying a new home from a builder a Solicitor can protect your interests by making sure that:
- Development charges are capped.
- Extension periods are restricted to the provisions of Tarion only.
- Driveways are included in the price.
- There is precise dollar amount for extra costs in the offer or for a maximum amount towards closing costs for utilities, building compliance issues, subdivision compliance matters like fences, walls, bushes, trees and grading & damage deposit.
- There is a clause stating the minimum and maximum beyond which the builder cannot alter the actual size of the house.
- It is negotiated that the vendor/builder to indemnify the purchaser in the event that any amount on account of development , education or other charges are subsequently assessed or taxable against the purchaser by reason of the builder non-payment at the time the building permit is issued.
- A clause is inserted to ensure that the contract can be terminated if the builder provides a house with the carpet area less than what is mentioned in the agreement.
- There is a provision that the builder will provide a completion certificate when handing over the house.
